Small Claims & Justice Court Service of Process Rules in Nevada

Complete guide to serving Small Claims Orders to Appear ($10,000 limit) and Justice Court civil summonses ($15,000 limit) in Las Vegas, Henderson, Reno, and across Nevada.

Understanding Nevada’s Two-Tier Justice Court System

In Nevada, the Justice Courts—established in each township across the state’s 17 counties—handle the overwhelming majority of everyday civil disputes, landlord-tenant cases, and consumer debt claims. Before serving your papers, it is crucial to distinguish between the two civil tracks inside a Nevada Justice Court:

  1. Nevada Small Claims Court (Jurisdictional Limit: Up to $10,000): Governed by NRS Chapter 73 and Part IX of the Justice Court Rules of Civil Procedure (JCRCP 88–100). Small Claims is designed as an informal, expedited forum for recovering money only (up to $10,000, excluding statutory interest and costs under NRS 73.010).
  2. Justice Court Civil Division (Jurisdictional Limit: Up to $15,000): Governed by NRS 4.370 and JCRCP 1–87. Regular Justice Court civil actions cover monetary claims up to $15,000 (above $15,000, original jurisdiction belongs to the Nevada District Courts).

Step 1: Mandatory Pre-Suit Demand Letter in Clark County Small Claims

Before you even file a Small Claims Affidavit of Complaint in Las Vegas Justice Court, Henderson Justice Court, or North Las Vegas Justice Court, be aware of a strict local pre-suit requirement:

  • 10-Day Demand Letter via Certified Mail: In Clark County townships, the plaintiff must first send a formal written Demand Letter to the defendant via Certified Mail, Return Receipt Requested, giving the defendant 10 to 15 days from the date of the letter to pay the debt voluntarily before a Small Claims case is filed. You must file a copy of the Demand Letter and the USPS Certified Mail receipt along with your Small Claims Complaint, or the Referee/Judge may dismiss your claim at the hearing.

Step 2: How Small Claims Papers Must Be Served in Nevada (JCRCP 90 & NRS 73.010)

Once your Small Claims Affidavit of Complaint and Order to Appear (or Mandatory Mediation Order in Las Vegas Justice Court) is issued by the Justice Court Clerk, it must be legally served on every named Defendant.

Under JCRCP 90 and local Township Justice Court rules, how must Small Claims papers be served?

Personal Hand-Delivery vs. Certified Mail Rules

While JCRCP 90 mentions registered or certified mail with return receipt signed by the defendant, in actual practice across Nevada:

  • Why Certified Mail Fails 80% of the Time: For certified mail to constitute valid service in Small Claims, the restricted delivery green card (Return Receipt) must be signed by the named Defendant themselves. If the defendant ignores the pink USPS slip, refuses the letter, or has an unauthorized person scribble a signature, the court will not accept the service, and your hearing date will be vacated or continued!
  • Why Personal Service by a Licensed Process Server (NRS Chapter 648) Is the Gold Standard: In Las Vegas Justice Court, Henderson Justice Court, and Reno Justice Court, personal hand-delivery by a PILB-licensed private process server (or Sheriff/Constable) is the fastest, most reliable way to guarantee your Small Claims hearing goes forward on schedule.
  • No Party May Serve Their Own Papers: Under JCRCP 4(c) and JCRCP 90, the Plaintiff can never personally hand-deliver the Small Claims Order to Appear to the Defendant.

Strict Service Deadlines Before the Small Claims Hearing Date!

Unlike regular civil lawsuits (where the defendant’s 20-day or 21-day time to answer only starts ticking after they are served), a Small Claims Order to Appear (or Mandatory Mediation Notice) usually has a pre-set hearing or mediation date printed on the face of the order!

Because the hearing date is fixed on the court’s calendar, Nevada Justice Courts enforce strict minimum advance notice deadlines prior to the hearing:

Nevada Justice Court / Township Minimum Service Deadline Before Hearing / Mediation Proof of Service Filing Deadline
Las Vegas Justice Court (200 Lewis Ave, Las Vegas) Must be served within 90 days of filing; if setting a hearing/mediation date, must be served at least 10 to 20 calendar days prior to the scheduled date File Return of Service at least 3 to 5 judicial days prior to the scheduled mediation/hearing
Henderson Justice Court (243 S. Water St, Henderson) Must be served at least 10 to 20 calendar days before the scheduled Small Claims trial date File Affidavit of Service immediately upon completion (at least 5 days before hearing)
Reno Justice Court (1 S. Sierra St, Reno) Must be served at least 10 calendar days before the Small Claims hearing date (or within the window stated on the Order) File Proof of Service prior to the hearing date
Rural Nevada Justice Courts (Pahrump, Fallon, Elko, Minden, Carson City) Generally 10 to 20 days prior to the appearance date printed on the Small Claims Order File Return of Service with the Township Clerk before the hearing

What Happens If You Miss the Service Window? If your Small Claims defendant is served fewer than the required number of days before the hearing, the defendant cannot be defaulted on that hearing date; instead, you must request a Reset / Amended Order to Appear with a new hearing date. That is why ordering Rush ($125) or Same-Day ($175) service from a licensed private process server is critical when your hearing date is less than three weeks away!

Venue Rules in Nevada Small Claims Court (NRS 73.010)

A critical jurisdictional rule unique to Nevada Small Claims Court (NRS 73.010(1)) is that the defendant must currently reside, do business, or be employed in the specific Township where the Small Claims action is filed (or, in certain real property/landlord-tenant security deposit claims under NRS 73.015, where the rental property is located).

  • For example, if the defendant lives and works in Henderson Township, you must file your Small Claims case in Henderson Justice Court—even if the car accident or contract happened on the Strip in Las Vegas Township!
  • By contrast, if you file a regular Justice Court Civil Action ($0 to $15,000) under NRS Chapter 66, broader venue rules apply (allowing filing in the township where the contract was to be performed or where the obligation was incurred).

Serving Regular Justice Court Civil Summonses ($15,000 Limit)

In regular Justice Court civil cases (up to $15,000), service of process follows JCRCP 4, which mirrors the Nevada Rules of Civil Procedure (NRCP 4 and NRCP 4.2):

  • 120-Day Deadline (JCRCP 4(e)): The Summons and Complaint must be served within 120 days of filing.
  • 20-Day Answer Period (JCRCP 12(a)): Once served with a Justice Court Civil Summons and Complaint, the defendant has 20 calendar days (note: 20 days in Justice Court under JCRCP 12(a), compared to 21 days in District Court under NRCP 12(a)!) to file a written Answer with the Justice Court Clerk.
  • Licensed Process Server Declaration (NRS 53.045): Every Return of Service we execute for Nevada Justice Courts includes our mandatory Nevada PILB Process Server License Number, GPS timestamped attempt history, and physical description of the recipient.
