How to Serve a Writ of Garnishment or Execution in Nevada (NRS Chapter 21 & 31)

Complete legal guide to post-judgment enforcement in Nevada, including serving Writs of Garnishment on banks and casino payroll departments under NRS 31.260 and the mandatory $5.00 NRS 31.270 fee.

Post-Judgment Enforcement in Nevada: Writs of Execution vs. Writs of Garnishment

Winning a civil money judgment in a Nevada District Court or Justice Court is only half the battle. If the judgment debtor refuses to pay voluntarily, the judgment creditor must enforce the judgment by levying on the debtor’s bank accounts, garnishing their wages, or seizing non-exempt personal or real property under Nevada Revised Statutes (NRS) Chapter 21 (Enforcement of Judgments) and NRS Chapter 31 (Attachment, Garnishment and Other Extraordinary Remedies).

One of the most valuable—yet frequently misunderstood—provisions of Nevada law is who can legally serve a Writ of Garnishment in Nevada and how to bypass weeks of Sheriff or Constable backlog when freezing a debtor’s bank account or garnishing wages at a Las Vegas resort.

Critical Distinction: Can a Private Process Server Serve a Writ of Garnishment in Nevada?

In many states, only a county sheriff can serve a bank levy or wage garnishment. Nevada is much more creditor-friendly! Under Nevada law, you must distinguish between the Writ of Execution (directed to the Sheriff/Constable) and the Writ of Garnishment (which garnishes funds or wages held by a third party such as a bank or employer):

1. Who Issues and Serves a Writ of Garnishment (NRS 31.249 & NRS 31.260)

  • Attorney Issuance (NRS 31.249(2)(a)): Once the Clerk of the Court issues a Writ of Execution, if the judgment creditor is represented by an attorney licensed in Nevada, the attorney themselves may issue and sign the Writ of Garnishment in aid of execution without waiting for the Sheriff or Court Clerk to sign the garnishment writ!
  • Service by Any Person Qualified to Serve a Summons (NRS 31.260(1)): Under NRS 31.260(1), a Writ of Garnishment must be served “by the sheriff of the county where the garnishee is found, or by any person who is qualified to serve a summons in a civil action, in the same manner as a summons in a civil action is served.”
  • Why This Matters for Judgment Creditors: Because NRS 31.260(1) explicitly authorizes service of a Writ of Garnishment by a PILB-licensed private process server (NRS Chapter 648), you do not have to wait 2 to 4 weeks for the Clark County Constable or Washoe County Sheriff to walk into a bank branch while the debtor drains their checking account! Our licensed process servers can serve a Writ of Garnishment on a Nevada bank branch or registered agent the exact same day ($175) or within 24 hours ($125), immediately freezing the debtor’s funds upon delivery.

2. Accounting & Return Coordination with the Sheriff or Constable (NRS 31.260(2))

Note how the two writs interact under NRS 21.112 and NRS 31.260:

  • The underlying Writ of Execution is directed to the County Sheriff or Township Constable (who acts as the collecting/accounting officer to receive garnished funds from the bank or employer and remit them to the creditor).
  • When a licensed private process server serves the Writ of Garnishment under NRS 31.260, the Writ of Garnishment instructs the garnishee (the bank or employer) to deliver their sworn answers to the Garnishment Interrogatories and remit any withheld funds directly to the designated Sheriff or Constable named in the Writ of Execution, and our server files the Return of Service of Writ of Garnishment with the court and/or levying officer.

Mandatory Statutory $5.00 Garnishee Fee at the Time of Service (NRS 31.270)

DO NOT FORGET THIS RULE: Under NRS 31.270(1), at the time of serving the Writ of Garnishment, the Garnishee (the bank or employer) must be paid or tendered a statutory fee of $5.00:

  • Consequence of Omitting the $5.00 Fee: Under NRS 31.270(1), “unless the fee is paid or tendered to the garnishee or the person upon whom service is made for the garnishee, at the time of the service thereof, the writ of garnishment shall be deemed not to have been served, and the garnishee is not required to answer the writ.”
  • How We Handle the $5.00 Tender: Whenever you dispatch a Nevada Writ of Garnishment through Nevada Process Servers, we can advance and physically attach the mandatory $5.00 statutory garnishee check/cash tender at the time of service, and we explicitly state on our sworn Return of Service that the $5.00 statutory fee pursuant to NRS 31.270 was tendered upon delivery.

Serving Writs of Garnishment on Major Nevada Employers (Casino Resorts) & Banks

1. Serving Las Vegas Casino & Hospitality Payroll Departments

Clark County’s largest private employers are hospitality and gaming giants—including MGM Resorts International (Bellagio, Aria, MGM Grand, Mandalay Bay), Caesars Entertainment (Caesars Palace, Harrah’s, Paris, Horseshoe, Planet Hollywood), Wynn Resorts, Venetian / Palazzo, Station Casinos (Red Rock Resorts), and Boyd Gaming.

  • Where to Serve: Attempting to walk onto a casino floor on Las Vegas Boulevard to hand a wage garnishment to a pit boss or hotel front desk will result in refusal. Most major Nevada casino resort entities accept legal process and wage garnishments either through their Carson City Commercial Registered Agent (CT Corporation System at 701 S. Carson St, Suite 200 or Corporation Service Company [CSC] at 112 N. Curry St, Carson City) or at their designated Corporate Legal / Centralized Payroll Garnishment Intake Office in Las Vegas. See our MGM, Caesars & Wynn Subpoena & Garnishment Service Guide for exact intake routing.

2. Serving Financial Institutions & Banks in Nevada (NRS 31.280)

When serving a bank levy / Writ of Garnishment on a financial institution in Nevada (such as Wells Fargo, Bank of America, JPMorgan Chase, U.S. Bank, Nevada State Bank, or America First Credit Union):

  • Under NRS 31.260 and NRCP 4.2(c), service may be made on the bank’s Nevada Registered Agent (typically CT Corp or CSC in Carson City) or on a branch manager / officer at a Nevada branch office.
  • Once served with the Writ of Garnishment and the $5.00 NRS 31.270 fee, the garnishee has 20 days under NRS 31.290 to answer the statutory Garnishment Interrogatories under oath.

Mandatory Notice of Execution & Exemption Claim Forms to the Judgment Debtor (NRS 21.075 & NRS 21.076)

Under NRS 21.075 and NRS 21.076, whenever a Writ of Execution or Garnishment is levied against an individual judgment debtor’s property, wages, or bank account:

  • A statutory Notice of Execution (containing the statutory list of Nevada exemptions under NRS 21.090, such as the 75% disposable earnings exemption or the personal bank account wildcard exemption, along with the blank Affidavit of Exemption form) must be served upon the judgment debtor (typically by first-class and certified mail to the debtor’s last known address within the statutory window after levy).
  • If the debtor files a timely Claim of Exemption within 10 calendar days after the Notice of Execution is mailed (NRS 21.112), the court holds an expedited hearing to determine whether the funds are exempt.

Debtor Examinations (Orders for Appearance of Judgment Debtor — NRS 21.270)

What if you don’t know where the judgment debtor banks or works? Under NRS 21.270, a judgment creditor is entitled to obtain an Order for Examination of Judgment Debtor requiring the debtor to appear before the judge or master to answer under oath concerning their property, bank accounts, and income.

  • Strict Personal Service Required: Because failing to appear at a Debtor Examination can result in a civil Bench Warrant for Contempt (NRS 21.270(3)), the Order for Appearance of Judgment Debtor must be personally served on the judgment debtor in the same manner as a summons before the scheduled examination date.
